The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization (WHO). COVID-19 is reported to be extremely contagious and potentially life-threatening. The exact methods of spread and contraction are unknown, and currently, there is no known treatment or cure for COVID-19. Nehoiden Golf Club at Wellesley College (“NGC”) and its employees, officers, directors, and agents will be providing a Women’s Golf program, including access to the premises and facilities in a manner consistent with CDC and state health and safety guidelines, which can include, but are not limited to, enhanced cleaning and disinfection of surfaces, use of facial coverings and adherence to physical distancing requirements of 6 feet or greater. NGC cannot prevent participants from becoming exposed to, contracting or spreading COVID-19 while on the premises of NGC. Therefore, if you choose to participate in NGC Women’s Golf Program and/or enter onto the NGC premises, you may risk exposure to COVID-19, and the potential spread of COVID-19. I represent that: A. I (or any of my child[ren] who may participate) have not tested positive for COVID-19 and/or had a suspected or diagnosed case of COVID-19 within the past 30 days; and/or B. I (or any of my child[ren] who may participate) do not currently have any symptoms which have been identified by the WHO and CDC as suggestive of having COVID-19. I (or any of my child[ren] who may participate) agree to A. Be responsible for monitoring my symptoms (or any of my child[ren]) daily and notifying the NGC Director at nehoidengolfacademy@gmail.com if I am feeling feverish or have a measured temperature of 100.4°F (38°C) or higher. B. Adhere to CDC, State of MA and Mass Golf Association health, safety and physical distancing guidelines while at NGC, as well as any rules, regulations, and directives implemented by NGC, including the wearing of masks when in practice areas, during transit between practice areas, and times when physical distancing is not possible during Women’s Golf Programs. Assumption Of Risk: I have read the above and understand the risks concerningCOVID-19. I hereby choose to assume the risk of contracting COVID-19 for myself and, if applicable, my participating child[ren] for whom I sign on their behalf. Waiver Of Liability/Indemnification: I hereby release, waive, discharge and covenant not to sue NGC, and its owners, directors, shareholders, employees, staff, and/or related entities (the "Releasees") in connection with exposure, infection, and/or spread of COVID-19 arising from or related to participation in NGC activities. I sign on my own behalf and as legal guardian of any minor children who participate in NGC activities. I agree to indemnify and hold harmless the Releasees from any loss, liability, or damages may incur, whether caused by negligence, active or passive or otherwise, in connection with participation in NGC’s programs. I further agree that if despite this release, I make a claim against any or all of the releases, I will indemnify and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost any Releasees may incur as the result of any such claim. I understand that this document is written to be as broad and inclusive as is permitted by law. I agree that if any portion is held invalid or unenforceable by a court of competent jurisdiction, said court shall interpret the document as broadly as legally allowed, and I will continue to be bound by the remaining terms.
